Mayo Wynne Baxter has once again been named as one of only 24 firms nationwide to be part of the Solicitors Regulation Authority’s new panel of intervention agents that will intervene into and close down solicitors' practices where an Intervention Resolution has been passed by the Solicitors Regulation Authority for disciplinary or other reasons. The aim of this process is to supervise the closure of the practice and take possession of all client monies and files to protect clients’ interests. Mayo Wynne Baxter is the only firm in Sussex or Kent to be appointed to the Panel.

Clinical Negligence Team concerned over local maternity unit closures
New NHS figures obtained under the Freedom of Information Act by Shadow Health Secretary Andrew Lansley show a sharp rise in the temporary closure of maternity units during 2008. The total number of closures was up 38% from 2007, with 553 closures this year compared with 402 in 2007. Such closures result in mothers to be having to go elsewhere, sometimes resulting in travelling to alternative maternity units many miles away.

New Arrival
Mayo Wynne Baxter is delighted to announce the arrival of Michael Mulcare to its Defendant Litigation Team. Michael joins the firm's Brighton office having run an insurer's in-house legal team for the past year. Prior to that he was with the Treasury Solicitor's Ministry of Defence team, mainly defending a wide range of high value personal injury claims against the Forces and was involved in a substantial amount of Inquest work. He acted on the 6-month long Inquest relating to the death of a serviceman from exposure to a chemical warfare nerve agent at Porton Down in the 1950's and the subsequent judicial review proceedings and class actions. He also dealt with diving related deaths and advising the Defence Diving School. He has a considerable background in personal injury work.

Mayo Wynne Baxter client obtains settlement of £200,000
A Mayo Wynne Baxter client recently agreed a settlement of £200,000 of his clinical negligence claim against a local NHS Trust. Our client, 64, underwent complex orthopaedic surgery designed to relieve longstanding back. In the days following surgery it emerged that our client had contracted an infection at the site of the surgery. Our client had to return to hospital on numerous occasions for treatment of the infection, which culminated in reversal of the original procedure. Our client contended that the infection resulted from negligent care and that he is now significantly more disabled as a result of the infection.

HIPs Update
The announcement by Ruth Kelly on 22nd May has left the future of Home Information Packs (HIPs) hanging in the balance. It seems they will still go ahead on 1st August - at least for properties with 4 or more bedrooms - but it will no longer be necessary for the HIP to be in place at the first point of marketing, instead the HIP will merely have to be "commissioned". Presumably, yet further revised regulations will be issued in due course, to include what arrangements will apply for 1 - 3 bedroom properties, but it may be that the Government will take this opportunity for a radical re-think of its policy. We expect Energy Performance Certificates to survive, but maybe on the basis that those merely have to be applied for at or prior to first marketing.

Wynne Baxter introduce new age package
Wynne Baxter solicitors has introduced a new retirement procedure template as a result of the recent age discrimination laws. The latest legislation means that it is compulsory for all employers to follow the procedure when they are dismissing an employee due to retirement. Wynne Baxter’s template policy is aimed at businesses of any size, and there are very few firms outside of London who have such a procedure up and running.

Wynne Baxter’s employment team success
Wynne Baxter is celebrating another success - and this time it’s because Jo Williams from the employment team has qualified as a solicitor. Jo, who is 28 and from Hove, formally became a solicitor earlier this month, following four years studying law. This involved a law conversion course at Sussex University, a legal practice course at the College of Law in Guildford, and two years undertaking a training contract. This followed a degree course in social anthropology with development studies.

Victory for Wynne Baxter Employment Group
The Wynne Baxter employment group recently won a resounding victory in the Brighton Employment Tribunal in a claim by a group of teachers against their former employer, Newlands School. The teachers all lost their jobs when the school they were working for closed unexpectedly in April 2006. 24 of 38 teachers were represented by Wynne Baxter in their employment claims against the school. The total compensation awarded is likely to be a six figure sum.

Throughout November the will writing team at Wynne Baxter is taking part in the Will Aid scheme by volunteering their time free of charge to draw up a will.
